1. Definitions and Scope

This Charter Agreement governs the hire of the commercial passenger vessel Lady Alice, operated by Black Pearl Maritime Experiences, by the client or charterer.

By sending a booking request, confirming a booking with our team, or boarding Lady Alice, the charterer confirms acceptance of these terms on behalf of themselves and all attending guests in their party.

2. Booking Requests

A booking starts with a request sent through our website, with your preferred date, time and occasion.

3. Booking Confirmation

To confirm a charter following consultation:

• Your booking is confirmed once our charter team confirms it to you in writing.
• The commercial terms for your charter are shared in writing with your booking confirmation.
• Boarding details are shared once your booking is confirmed.

4. Guest Limits and Port Security Manifest

Lady Alice is certified by the Directorate General of Shipping and Mumbai Port Trust for a maximum capacity of 100 guests.

Under maritime security directives from the Indian Coast Guard and Mumbai Port Police, the charterer must submit a passenger manifest containing legal names and government identity numbers for all attendees at least 24 hours prior to departure.

Total on-board headcount cannot exceed the certified 100-guest threshold under any circumstances.

5. Master Captain Maritime Authority

The appointed Master Captain of Lady Alice exercises absolute command over vessel navigation, speed, route, and passenger safety.

The Captain reserves the right to modify the sailing route or anchor location based on tidal shifts, maritime traffic, or weather squalls, and to deny boarding to any individual whose conduct threatens safe operations.

6. Boarding Protocol at Jetty No. 2

All charter departures operate from Jetty No. 2, Princess Ferry Wharf (Bhaucha Dhakka), Mazgaon, Mumbai 400010.

Guests must assemble 30 minutes before the scheduled booking time. Because harbor jetty berths operate under rigid port schedules, charter duration commences strictly at the scheduled booking hour. Arrival delays cannot extend the cruising slot.

7. Prohibited Items and Conduct

To ensure passenger safety and regulatory compliance:

• Illegal narcotics and contraband are strictly prohibited under Indian maritime law and result in immediate voyage termination.
• Swimming from the vessel into Mumbai Harbour is prohibited at all times.
• Hand-held fireworks and open flare pyrotechnics are not permitted on deck.

8. Alcohol and Acoustic Guidelines

Alcohol service requires guests to be of legal drinking age under a valid temporary state liquor permit (FL-4 permit), which our team assists in obtaining.

Amplified music and DJ consoles are permitted on deck in compliance with coastal environmental decibel regulations. Sound levels may be moderated by the Master Captain upon entering regulated harbor navigation channels.

9. Weather and Force Majeure

Lady Alice features covered lounges and sheltered deck spaces for year-round comfort. If the Directorate General of Shipping or Mumbai Port Authority restricts harbor navigation due to cyclonic alerts or severe squalls, the charter is rescheduled to a new date of the charterer's choice within 12 months.

10. Liability and Legal Jurisdiction

The operator maintains commercial hull, marine third-party, and passenger liability insurance. The operator is not responsible for loss of or damage to personal items brought on board by passengers.

This agreement is governed by the laws of India. The courts situated in Mumbai, Maharashtra hold exclusive jurisdiction over any disputes.
